This Privacy Policy explains how Swimwear Agency ("we", "us") collects and uses personal data when you use swimcreator.com or contact us, in line with the EU General Data Protection Regulation (GDPR) and Irish data protection law.

1. Data controller

The data controller is Swimwear Agency, a company incorporated in Ireland. For any privacy matter, contact us at brands@swimwear.agency.

2. What we collect

  • Enquiry details you choose to send us when you contact us by email, Instagram, WhatsApp or Telegram (e.g. your name, brand, contact details and message).
  • Technical data automatically generated when you visit the site (e.g. IP address, browser type and pages viewed), processed by our hosting provider for security and to operate the site.
  • Account data if you log into a client area (e.g. email and an authentication token stored in your browser).

We do not knowingly collect special-category data, and we do not sell your personal data.

3. How and why we use it

  • To respond to your enquiry and provide our services (legal basis: steps prior to a contract, and performance of a contract).
  • To operate, secure and improve the website (legal basis: our legitimate interests).
  • To comply with legal obligations where they apply.

4. Sharing and processors

We share data only with service providers who help us run the site and business, under appropriate agreements, including our hosting and CDN provider (Cloudflare), our backend and database provider (Xano), and file delivery (Dropbox). We may also use the messaging platforms you choose to contact us through. These providers act on our instructions.

5. International transfers

Some providers may process data outside the European Economic Area. Where that happens, we rely on appropriate safeguards such as the European Commission's Standard Contractual Clauses.

6. Retention

We keep personal data only as long as necessary for the purposes above and to meet legal requirements, after which it is deleted or anonymised.

7. Cookies and storage

We use only storage that is strictly necessary to operate the site (for example, keeping you signed in to a client area). We do not use third-party advertising or tracking cookies. If we introduce analytics in future, we will ask for your consent where required.

8. Your rights

Under the GDPR you have the right to:

  • access the personal data we hold about you;
  • have inaccurate data corrected;
  • have your data erased;
  • restrict or object to processing;
  • data portability;
  • withdraw consent at any time, where processing is based on consent.

To exercise any of these, email brands@swimwear.agency. You also have the right to lodge a complaint with the Irish Data Protection Commission (dataprotection.ie) or your local supervisory authority.
